Rape: Delhi court grants bail to man accused of raping classmate | Delhi News

New Delhi: A Delhi court recently granted bail to a man accused of raping his classmate. It stated that the complainant woman had not opposed the bail application, the chargesheet had been filed in the case, whether the accused had sexually assaulted the woman was the subject of the trial and the accused was not involved in any other case. “Perusal of the forensic case shows that there are no signs of physical injury or external injuries. The complainant has refused to undergo internal examination,” Additional Sessions Court Judge Manoj Kumar said in an order dated June 22. The 21-year-old complainant, a classmate of the accused at Delhi University’s School of Open Learning, was in a relationship with him since they were both in Class 12 together. After a delay of nearly six months, a case was registered against the 20-year-old accused in March this year for the alleged offences of rape, criminal intimidation and insulting the modesty of the woman. According to the prosecution, the alleged crime took place in October 2023 at the woman’s house in the presence of her two friends. However, the said friends denied any knowledge of such an incident during police interrogation. The defence counsel claimed that the accused, who was in custody since April 12, was innocent and falsely accused after the relationship between the woman and the accused broke down. The prosecution, however, argued that there were serious allegations against the accused and the obscene pictures and videos found on his mobile phone corroborated the woman’s statement. The prosecution also stated that if the bail was extended, the accused might abscond or threaten the witnesses. The court observed that the woman refused to produce her mobile phone for examination despite a notice under Section 91 CrPC. The section allows a court or police officer to issue summons and written orders to a person in possession of any document/other article required for examination, investigation, trial or any other proceeding. The court granted bail to the accused on a personal bond of Rs 20,000 and a surety of like amount. It also imposed many other conditions for the bail. tnn
